Another Federal Court Approves Constructive Trust Remedy to Enforce Subrogation/Reimbursement Rights
Forsling v. J.J. Keller & Assocs. (E.D. Wis. 2003). Wisconsin State Court Enforces Plan's 'Subrogation' Claim Under State Law
Palmerton v. Associates' Health and Welfare Plan (Wis. Ct. App. 2003). Excerpt: "Yet another subrogation and reimbursement case appeared on the radar this week, adding to the flurry of cases we have covered since the U.S. Supreme Court's Knudson decision in January 2002.... [The plaintiff argued that Knudson] limited the plan to equitable remedies, so that equitable defenses (like the make-whole rule and the common-fund doctrine) could be asserted. Plan's Exclusion of Coverage For "Surgical Impregnation Procedures" Did Not Violate Title VII or PDA
Saks v. Franklin Covey Co. (2d Cir. 2003). Excerpt: "The employee in this case sued for reimbursement of infertility treatment expenses from her employer's self-insured health plan. The plan specifically excluded coverage for 'surgical impregnation procedures,' including artificial insemination and in vitro fertilization--procedures that the employee had undergone several times." Firm Properly Denied Coverage of Gender Reassignment Surgery As Not Medically Necessary
The Second Circuit U.S. Court of Appeals has ruled that an employer properly denied coverage of an employee's gender reassignment surgeries as not being 'medically necessary.' The ruling came in Mario v. P&C Food Markets, Inc. (No. 01-9220). (SpencerNet)

Supreme Court Holds That Untimely Assignment Under 1992 Coal Act Is Valid
In a 6-3 decision in two consolidated cases, the U.S. Supreme Court has held that the untimely assignment of health care benefit liability under the Coal Industry Retiree Health Benefit Act of 1992 is still valid. The cases are Barnhart v. Peabody Coal Company, et al. (Docket No. 01-705) and Holland, et al. v. Bellaire Corporation, et al. (Docket No. 01-715). (SpencerNet)
