Judge Tosses Schering-Plough Stock Drop Suit

Excerpt: "A federal judge has thrown out a stock drop lawsuit against drugmaker Schering-Plough, but has permitted plaintiffs to strengthen its allegations of wrongdoing and refile it. U.S. District Judge Dennis M. Cavanaugh of the U.S. District Court for the District of New Jersey said the action was necessary because participants' initial attempt to levy fiduciary breach allegations fell short of proving the company had advance knowledge of clinical trial results for the drug Vytorin. Vytorin is a combination drug comprised of Merck & Co.'s cholesterol drug Zocor and Schering-Plough's drug Zetia." (PLANSPONSOR.com; free registration required)

An EBSA news release said Field Assistance Bulletin (FAB) 2009-03 describes how an individual account plan can stay under 404(c) protection under the Employee Retirement Income Security Act (ERISA) by giving out the new summary prospectus, under Securities and Exchange Commission (SEC) guidelines." House Republican Leader Backs Obama's Savings Initiatives
Excerpt: "'Republicans are pleased President Obama has joined us in calling for action to help Americans rebuild their lost savings (see Obama Administration Launches Retirement Initiatives). Millions of Americans have watched with anxiety in the past year as the value of their 401(k)s, college savings plans and other vital savings accounts have plummeted, and government should not be an impediment as they work to restore what they've lost,' he said in a press release." (MarketWatch, Inc.)

Laying the Groundwork for Pension Reform
Excerpt: "Make no mistake about it. Pension reform is on the way. But what that reform will look like is anyone's guess at the moment. All we know is this: Lawmakers, and especially Rep. George Miller, D-Calif., chairman of the House Education and Labor Committee, are trying to get a handle on retirement crisis in the country and the best way to solve our problems."
