Proposed Rules Issued for New Jersey Paid Sick Leave Act

"An employer would not be required to maintain records documenting the hours worked by exempt employees, but rather has the option of either recording the actual hours worked by that employee for the purpose of calculating earned sick leave accrual or presuming, solely for the purpose of calculating earned sick leave accrual, that the employee works 40 hours per week. Where an employee is terminated, laid off, furloughed, or otherwise separated from employment and where the employee is reinstated or rehired in New Jersey by the same employer within six months of the separation, any unused earned sick leave accrued by or advanced to the employee prior to the separation would be required to be returned to the employee upon rehire or reinstatement." ACA Non-Reporting: IRS Letter 5699

"While it is not clear how the IRS identifies employers who might be subject to reporting, but didn't file, the IRS may be identifying potential non-filers from Form W-2 filings or other tax filings.... [S]eparate, and sometimes overlapping, reporting requirements for insurers and employers... has led to a few common misconceptions ... [1] We don't have 50 full-time employees, so these rules don't apply to us.... [2] Our employees are in separate companies, under separate tax ID numbers/EINs, and none of the companies is over the 50 full-time and full-time equivalent employee threshold, so these rules don't apply to us.... IRS Updates Guidance on Paid Family Leave Tax Credit

"The Credit applies to employers that grant employees earning less than $72,000 in 2017 at least two weeks of annual paid family and medical leave for full-time employees, and a proportionate amount for part-time employees where the paid leave rate equals at least 50% of the employee's qualifying wages. The Credit for employers may total between 12.5% and 25% of such qualifying wages." Littler

California Takes Another Swipe at Administration's Rule on Association Health Plans

"California is the first state to legislatively prohibit some of its residents from taking advantage of a Trump administration rule that expanded access to small business health plans. The state now prohibits sole proprietors from joining what's known as association health plans.... The move by California will mean real estate agents and others who operate as sole proprietors won't be able to join association health plans. The National Association of REALTORS is a major supporter of the DOL's expansion of the plans." Bloomberg BNA
